POKER RUSH Staking Agreement and Terms

This Agreement sets forth the terms and conditions regarding the staking and profit distribution for poker tournaments between the backer, "POKER RUSH" (hereinafter referred to as the "Backer"), and the backed player (hereinafter referred to as the "Player"), as well as the rights and obligations of both parties.

Article 1: Target Tournaments and Establishment of Staking

The Player may apply for staking for specific tournaments from the "Tournament List" after reviewing the staking percentages specified in the "Staking List" provided by the Backer.

This staking agreement shall officially enter into force only when the Backer reviews and issues a formal "Approval" in response to the Player's application. Any tournament played without the Backer's prior approval shall be outside the scope of this Agreement and shall be at the Player's sole responsibility and expense.

Article 2: Distribution of Profits and Winnings

【Distribution Rate】 Any winnings (before taxes and excluding official tournament administrative fees) accrued by the Player in the target tournament shall be strictly distributed based on the pre-agreed staking percentage (or individually agreed distribution rate).

【Treatment of Bounties】 In tournaments featuring bounties, including Progressive Knockouts (PKO), all bounty prizes cash-outed or collected by the Player shall be deemed part of the total prize pool and subject to the distribution specified in Paragraph 1.

【Trophies and Non-Cash Prizes】 Any promotional prizes, luxury goods, or non-cash rewards (such as trophies, watches, or future tournament entry tickets) awarded to the Player shall be converted into cash based on objective market value and distributed in accordance with the ratio specified in Paragraph 1.

Buy-In and Winnings Distribution Ratio

For all staking arrangements, when the Player wins prize money, 70% of the Buy-In belongs to POKER RUSH and 30% belongs to the Player.

The profit distribution applied to the winnings shall be the profit distribution rate agreed upon at the time of application.

Example: The Player entered a tournament with a 100 USD Buy-In and won 500 USD in prize money. In this case, 270 USD goes to POKER RUSH and 230 USD goes to the Player.

Article 3: Expenses, Re-entries, and Points

【Expenses】 All travel, accommodation, subsistence, and food/beverage expenses incurred by the Player for the tournament shall, in principle, be fully borne by the Player.

【Re-entries】 If the Player wishes to re-enter a tournament, they may apply for additional staking only if they possess a sufficient amount of "RUSH Points" and the tournament is designated as eligible for re-entry in the "Staking List." However, the application does not guarantee or secure a re-entry at the venue and shall be approved or denied at the sole discretion of the Backer on a case-by-case basis.

【Forfeiture of Points for Non-Participation】 In the event that an application is made and subsequently approved by the Backer, but the Player fails to participate (register) in the target tournament due to any reason attributable to the Player (including, but not limited to, poor health, oversleeping, scheduling errors, or other personal circumstances), the "RUSH Points" deducted or consumed from the Player's account for said application shall be strictly non-refundable, regardless of the circumstances.

Article 4: Player Obligations and Prohibited Actions

【Obligation of Honest Play】 The Player must maintain professional conduct and perform to the best of their abilities in the tournament at all times. The Player is strictly prohibited from engaging in soft play, chip dumping (collusion), intentionally unnatural aggressive or passive play, or any other fraudulent or inappropriate behavior.

【Reporting Duty】 The Player is obligated to promptly report their current chip count and overall status to the Backer at the end of each stage, upon being busted out (eliminated), and without exception, during every scheduled tournament break.

【Prohibition of Cross-Staking】 The Player shall not accept duplicate staking from any third party (cross-staking) or sell, swap, or trade any portion of their own stake with others for the same target tournament without the prior written consent of the Backer.

Article 5: Authority Over Deals and Chops

In the event that a deal or chop (prize pool division) is proposed among the remaining players (e.g., at the final table), the Player shall not accept, agree to, or finalize such an arrangement without the prior, explicit, and written approval of the Backer. The Player must immediately contact the Backer and follow their instructions.

Article 6: Settlement and Payment Deadline

【Immediate Settlement】 Upon the confirmation and receipt of any winnings (including bounties) from the target tournament, the Player (or the party receiving the payout) must immediately transfer and settle the Backer's share using the method designated by the Backer (such as Cash, Crypto Assets, or Bank Transfer).

【Withholding Tax】 If withholding tax is deducted at the venue by the casino or the official event organizer, the net payout amount (after-tax amount actually received) shall be used as the basis for calculating the distribution.

Article 7: Indemnification and Damages for Breach

Provided that the Player has fully complied with this Agreement and played to the best of their ability, if the Player fails to make the money (busts out), the Backer shall have no right to demand the return of the staked funds (acknowledgment of investment risk).

If the Player is disqualified from the tournament due to reasons outside of standard gameplay, including but not limited to misconduct, rule violations, poor etiquette, or any other breach attributable to the Player, the Player shall immediately compensate and fully reimburse the Backer for the entire amount staked (including any re-entries) for said tournament as liquidated damages.

Article 8: Minimum Guaranteed Prize Pool Requirement

Tournaments with a guaranteed prize pool (GTD) of 8,000 USD (500,000 PHP) or less are not eligible for staking under this Agreement. Only tournaments exceeding this threshold are considered as target tournaments for staking.

Article 9: GTO Practice Requirement for Point Purchase

To purchase RUSH Points, users must have completed at least 300 GTO Practice problems with an accuracy of 65% or higher. This requirement ensures that only users with sufficient poker knowledge can participate in the staking and points system.

However, this GTO Practice requirement is waived for users who purchase a plan through the Private Sale or presale. Users who have purchased a plan via the Private Sale or presale are exempt from this requirement.

Article 10: SNS Posting Obligations for Staked Players

Players participating in staking must post their registration receipt on the POKER RUSH SNS. During breaks, players must post their current chip stack, average stack, total number of entrants, and remaining players. Finally, upon busting out, players must upload a photo of their bust-out screen.
